Emergency Situation Defined

LESSEEs shall not have the right to perform nor arrange for repairs at LESSOR’S expense, nor shall there be any right of LESSEE to deduct the cost of any repairs from the rent payments due. All maintenance and repair work requested by the LESSEES and ordered by the LESSOR shall take place during normal business hours, Monday through Friday from 8 AM to 6 PM, excluding emergencies. Under our guidelines, and the Indiana Landlord Tenant Laws, emergency repairs shall be deemed as follows:

  • Major water leaks, including broken pipes or seriously clogged drains that could flood the premises. A clogged toilet is NOT an emergency unless that is the only toilet you have in the property.
  • No heat
  • No cooling if above 90 degrees.
  • Gas leaks
  • Electrical shorts or sparking
  • Serious roof leak
  • Dangerous or serious flood damage
  • Serious storm or fire damage
  • A failure of the water supply to the premises
  • A failure or breakdown of any essential service on the premise for hot water, cooking or heating
  • Any fault or damage to the premise that causes the premise to be unsafe and not secure
  • Any other condition which the LESSEE may deem life-threatening or pose a threat of harm to the premises. Please call 911 if you have a life-threatening emergency.
